By registering for and participating in any event, activity, tour, training session, race, competition, experience, or programme conducted by The Event Crew Limited ("the Event"), I acknowledge, understand, and agree to the following terms and conditions: 1. FITNESS TO PARTICIPATE I confirm that I have adequately trained and prepared for this Event and that I am physically and medically fit to participate. I either: • have consulted a medical practitioner regarding my suitability to participate; or • reasonably believe myself to be fit, healthy, and capable of safely participating in and completing the Event. I further confirm that I possess the skills, experience, and physical ability appropriate for the Event I have entered. 2. ACKNOWLEDGEMENT OF RISK I acknowledge that participation in endurance, sporting, recreational, and outdoor events involves inherent risks, dangers, and hazards that may result in serious injury, illness, permanent disability, property damage, psychological trauma, or death. These risks include, but are not limited to: • drowning; • exhaustion and overexertion; • hypothermia and hyperthermia; • marine life and wildlife encounters; • adverse weather conditions; • tides, currents, waves, and water quality; • collisions with participants, vehicles, vessels, structures, obstacles, or members of the public; • slips, trips, and falls; • cycling accidents; • road hazards; • trail hazards; • equipment failure; • transportation to and from event locations; • medical emergencies; and • negligence by myself or others. I voluntarily accept and assume all risks associated with my participation. 3. RELEASE OF LIABILITY To the fullest extent permitted by law, I release and discharge The Event Crew Limited and all associated parties from any liability arising directly or indirectly from my participation in the Event. This release includes: • The Event Crew Limited; • directors, officers, shareholders, employees, contractors, and consultants; • volunteers and officials; • event directors and organisers; • medical and paramedical personnel; • sponsors and commercial partners; • landowners and occupiers; • local authorities and regulatory agencies; and • any other person or organisation involved in the planning, management, or conduct of the Event. This release applies regardless of whether any injury, loss, damage, illness, or death results from negligence or any other cause. 4. INDEMNITY I agree to indemnify and hold harmless all released parties against any claims, demands, actions, proceedings, damages, losses, costs, or expenses arising from my participation in the Event. This indemnity remains binding upon my heirs, executors, administrators, personal representatives, and assigns. 5. MEDICAL CONDITION DISCLOSURE I agree to disclose any medical condition, injury, allergy, medication, disability, or health concern that may affect my ability to participate safely. I understand that failure to disclose relevant medical information may increase the risk to myself and others. 6. MEDICAL TREATMENT I authorise event organisers, safety personnel, and medical providers to administer any emergency treatment they consider necessary during or after the Event. I accept full responsibility for all associated medical and transport costs. 7. EVENT SAFETY I understand that safety systems, including safety briefings, marshals, rescue craft, emergency procedures, medical personnel, and course supervision are provided as assistance only and do not guarantee my safety. Participation remains entirely at my own risk. 8. EVENT ORGANISER AUTHORITY I agree to comply with all instructions and directions issued by event organisers, officials, marshals, volunteers, safety personnel, and authorised representatives. I acknowledge that organisers may refuse entry, disqualify, suspend, or remove me from the Event if they reasonably believe my participation may endanger myself, others, or the Event. 8A. PARTICIPANT WITHDRAWAL AND REMOVAL FROM THE EVENT I acknowledge and agree that event organisers, event directors, safety personnel, medical personnel, marshals, referees, officials, contractors, volunteers, and authorised representatives of The Event Crew Limited may, at their sole discretion, require me to stop, withdraw from, or be removed from any part of the Event at any time if they reasonably believe that my continued participation may endanger myself, other participants, event personnel, members of the public, or the safe operation of the Event. This authority applies to all event activities and environments, including but not limited to: • open water and swimming events; • cycling on roads, streets, shared pathways, and off-road trails; • running on roads, footpaths, shared pathways, tracks, trails, beaches, and other terrain; • transition areas; • event villages and venues; • transportation to and from event locations; and • any other activity associated with the Event. I agree to immediately comply with any instruction to stop, withdraw, board a safety vehicle or vessel, leave the course, or otherwise cease participation. I acknowledge that I do not have the right to refuse assistance or refuse a direction to withdraw once such a direction has been given by an authorised event official. No refund, credit, transfer, or compensation shall be payable if I am withdrawn, disqualified, or removed from the Event for safety, medical, behavioural, operational, environmental, or regulatory reasons. 9. EVENT CHANGES I understand that organisers may modify course distances, routes, schedules, locations, formats, start times, or other aspects of the Event due to safety, operational, environmental, regulatory, or logistical reasons. 10. WEATHER AND ENVIRONMENTAL CONDITIONS I acknowledge that environmental conditions may change rapidly and can include: • severe weather; • strong winds; • rough water; • poor visibility; • heat or cold exposure; • hazardous terrain; • traffic conditions; • poor road surfaces; • wildlife; and • water quality issues. I accept all risks associated with such conditions. 11. FORCE MAJEURE If the Event is cancelled, postponed, modified, shortened, or abandoned due to circumstances beyond the organisers' reasonable control, including but not limited to severe weather, natural disasters, pandemics, government restrictions, civil unrest, strikes, war, acts of terrorism, or other force majeure events, I understand that my entry fee will not be refundable. 12. REFUND AND TRANSFER POLICY All entry fees are non-refundable. Where permitted by the organisers: • Single-event entries may transfer up to 75% of their entry value to another event within the same season if arranged at least seven (7) days prior to the Event. • Multi-event pass holders may transfer entries by contacting organisers and paying any applicable transfer fee. Failure to arrange a transfer within the applicable timeframe will result in forfeiture of the entry. 13. COURSE DISTANCES I acknowledge that all advertised distances, routes, and times are approximate and may vary due to safety, environmental, operational, or regulatory requirements. 14. EQUIPMENT I am solely responsible for ensuring that all equipment used during the Event is suitable, safe, and in good working condition. Any equipment failure remains entirely my responsibility. 15. TIMING CHIP I agree to wear the official event timing chip as instructed by the event organisers. I understand that the timing chip remains the property of The Event Crew Limited and must be returned immediately following the Event, regardless of whether I start, finish, withdraw from, or do not participate in the Event. If the timing chip is not returned for any reason whatsoever, I agree to pay a replacement fee of NZD $50. 16. PERSONAL PROPERTY I accept full responsibility for all personal belongings and equipment brought to the Event. The organisers accept no responsibility for loss, theft, or damage. 17. PHOTOGRAPHY, FILMING, AND MEDIA I grant The Event Crew Limited and its authorised partners the unrestricted right to use my: • name; • image; • voice; • likeness; and • event results, for promotional, commercial, broadcast, advertising, media, and marketing purposes in any format worldwide without compensation. 18. EVENT SERVICE PROVIDERS I consent to my registration information being provided to authorised event service providers, including timing providers, photographers, media agencies, merchandise suppliers, contractors, sponsors, and other providers engaged by The Event Crew Limited for the purposes of event administration and participant services. 19. COMMUNICATIONS AND PERSONAL INFORMATION I consent to The Event Crew Limited collecting, storing, and using my personal information, including my name, email address, phone number, emergency contact details, event results, and participation history, for the purposes of: • event administration and safety management; • timing, results, and participant services; • operational communications; • email, telephone, and SMS communications; • promotional offers, products, services, and future events; • communications from approved event sponsors and partners; • photography and media services; and • improving and developing future events and services. I consent to being contacted by telephone call, SMS, email, and other electronic communication methods by The Event Crew Limited and its authorised partners. I understand that I may unsubscribe from marketing communications at any time; however, operational and safety communications may still be sent where necessary. 20. ALCOHOL AND DRUGS I confirm that I will not participate while impaired by alcohol, recreational drugs, or any medication that may affect my ability to participate safely. 21. AGE REQUIREMENTS I certify that I meet the minimum age requirements specified for my Event category. 22. PARTICIPANTS UNDER 16 YEARS If I am under 16 years of age, my parent or legal guardian confirms that they have read, understood, and accepted these Terms and Conditions on my behalf. 23. SEVERABILITY If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 24. GOVERNING LAW These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand. PARTICIPANT DECLARATION By completing my registration, I confirm that: • I have read and understood these Terms and Conditions; • I understand the risks associated with participation; • I voluntarily accept those risks; • I agree to be bound by these Terms and Conditions; and • I understand that I may be giving up certain legal rights by agreeing to participate.
